Linda Stanley fails to respond to three-county lawsuit and faces a $111,971 loss

She also has failed to make payments on $20,000 owed to the Office of Attorney Regulation

For the past few months, former District Attorney Linda Stanley has been desperately trying to save both her career and her net worth after being disbarred as an attorney in November due to her many ethical breaches during her tumultuous four-year term in office. However, to save her net worth, she needed to file a response to a lawsuit against her by Custer, Fremont, and Chaffee Counties that claimed she had misused public funds.

As previously reported in the Tribune, when Stanley was served the lawsuit in December, she responded by throwing the documents into the dirt. She had until last week to file a response, but court records show that nothing has been received by the courts.

The counties, in their lawsuit filed in December, stated that “Defendant expended a sum of at least $111,971.35 for the payment of legal fees incurred by Defendant and other members of her staff to defend against allegations of violations of the Colorado Rules of Professional Conduct, or ethical violations. By paying for legal fees that were not necessary expenses of maintaining an office for the transaction of official business, Defendant willfully, knowingly, and fraudulently converted funds appropriated by County to her own use and benefit and/or to a use other than the public use authorized by law.”

Stanley had been warned several times by Fremont County that she was to stop using District Attorney Funds to defend herself from the investigation by the Office of Attorney Regulation.

Because she did not file an answer to the lawsuit, it is expected that the three counties will file a Motion for Default Judgement in court shortly.

In a phone conversation with Fremont County Commissioner Kevin Grantham, he acknowledged that “we have long recognized that we might be trying to get blood out of a turnip. However, the taxpayers are owed their money, and we will make sure that it is eventually returned.”

In addition to the $111,971.35 dollars, Linda Stanley also owes the Colorado Supreme Court $20,000 for the two-week hearing in June that ultimately led to her disbarment. So far, she has not made any of the payments that were arranged for her. Stanley is appealing her disbarment to the Colorado Supreme Court, and no date for a hearing has been set.
